Terms of Use

These Terms of Use (“Terms”) govern your use of the Caper mobile application and related services. By downloading or using Caper, you agree to these Terms. If you do not agree, do not use Caper.
1. Eligibility and license
You must be legally capable of entering into these Terms or use Caper with permission from a parent or legal guardian. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Caper on Apple-branded devices you own or control, subject to these Terms and the App Store usage rules.
2. Acceptable use
You may use Caper only for lawful purposes. You must not misuse the app, interfere with its operation or security, attempt unauthorized access, reverse engineer it except where law expressly permits, evade feature or purchase controls, distribute malicious content, or use Caper to violate another person’s privacy, publicity, intellectual-property, or other rights.
3. Your content
You retain ownership of photos, videos, audio, and other content you create or import. You are responsible for having the rights and permissions needed to capture, edit, store, and share that content. Caper does not claim ownership of your content.
4. Caper Pro subscriptions
Caper may offer auto-renewable monthly or yearly subscriptions through Apple. The price and billing period shown by the App Store at purchase are controlling. Payment is charged to your Apple ID after confirmation. A subscription renews automatically unless canceled at least 24 hours before the end of the current period. Apple may charge renewal within 24 hours before that period ends. Manage or cancel subscriptions in your Apple account settings. Deleting Caper does not cancel a subscription.
Features are unlocked only after a verified transaction. You may restore eligible purchases using the same Apple ID. Refunds and billing are handled under Apple’s policies and applicable law. Free trials or promotional offers, if any, follow the terms shown at purchase.
5. App changes and availability
We may improve, change, suspend, or discontinue features. Some capture tools depend on device hardware, operating-system support, permissions, storage, and network or App Store availability. We do not promise that every feature will work on every device.
6. Third-party services
Caper relies on Apple services including the App Store, StoreKit, Photos, and device media frameworks. Your use of those services is also subject to Apple’s terms and policies. We are not responsible for third-party services outside our reasonable control.
7. Privacy
Our Privacy Policy explains how Caper handles information and is incorporated into these Terms.
8. Intellectual property
Caper, its software, brand, design, effects, and included materials are owned by us or our licensors and protected by law. These Terms do not transfer any ownership rights to you.
9. Disclaimers
To the extent permitted by law, Caper is provided “as is” and “as available.” We disclaim implied warranties that may lawfully be excluded. Nothing in these Terms limits rights that cannot be waived under applicable consumer law.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or opportunity arising from Caper. Our aggregate liability will not exceed the greater of the amount you paid for Caper in the 12 months before the claim or USD 50. These limits do not apply where prohibited by law.
11. Termination
You may stop using Caper at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, or misuse the service. Provisions that by nature should survive termination will remain effective.
12. Governing terms and Apple
These Terms supplement Apple’s Standard Licensed Application End User License Agreement. If these Terms conflict with Apple’s required terms, Apple’s terms control to the extent required. Governing law and dispute venue are those applicable to the provider named in the App Store listing, except where mandatory consumer law provides otherwise.
